1. INTRODUCTORY NOTE
The following are the terms and conditions that regulate access, browsing and use of the website www.watcool.com (hereinafter, the Website), the domain through which its owner and administrator, Home Office Delivery Services S.L. with CIF: B-98648470 and address at C/ dels Matalafers, N29, postcode 46394, Sector 13 del Polígono Industrial Masía San Antonio de Poyo - Ribarroja del Turia - Valencia - Spain provides and carries out its commercial activity.
As a user, it is necessary to read this document extremely carefully, since under the title of 'Legal Notice', the conditions of use and/or terms that govern and regulate access, browsing and use of the Web are detailed, so this implies the tacit acceptance by the user of all the conditions set out in these texts. The non-existence of a written contract signed by both parties does not detract from its validity or effectiveness, and the clauses set out below shall be enforceable in terms of compliance.
Any user who does not agree with what is set out in this 'Legal Notice' must refrain from accessing, browsing and using this website.
To contact the owner of the website, you can do so directly through the e-mail address info@watcool.com which we will attend to as diligently as possible, or by calling 961.642.607.
2. GENERAL TERMS AND CONDITIONS
Access, browsing and use of the Website implies acceptance by the user of this 'Legal Notice'.
The object and scope of application of the General Conditions that regulate access to the contents and products/services that the website offers through the domain www.watcool.com, and the use made by users, are described below.
For this purpose, a user is understood to be any person who accesses, browses or uses the products/services offered on the Website.
The administrator, without prejudice to this, reserves the right to make any changes to the website, and even to the conditions of access, browsing and use. When the user accesses, browses and uses the contents of the website, he/she accepts the changes and conditions that may have been made to it.
Regardless of the above, in order to access specific content or use certain services, special conditions may be established which, depending on the case, will replace, complete and/or modify the present conditions. In the event of any contradiction, the terms of the specific conditions shall prevail over the general conditions.
Prior to accessing the contents and/or using the aforementioned services, the user must carefully read the specific conditions. Access to and/or use or contracting of the specific products or services subject to specific conditions implies acceptance of these in the version published at the time of said use and/or contracting.
3. ACCESS TO THE WEBSITE
The website allows free access to all of its content; on the contrary, most of the products/services offered on the website are subject to an official commercial relationship, a contract and payment of a monetary amount agreed in this particular commercial relationship, the particular conditions of which will be communicated to the user at any time he/she may require as clearly as possible.
Minors are not allowed to enter the website, except with the prior formal and valid authorisation of their parents or legal guardians, who shall be responsible for the actions of the minor in their charge, in accordance with the terms established in the regulations in force.
4. USE OF THE WEBSITE
The entire content of the website is intended exclusively for end consumers, so the commercial use of the products/services advertised on the website is strictly prohibited unless authorised in writing and signed by the website administrator.
To this end, the user undertakes to use the website in accordance with the Law and with the conditions set out in this 'Legal Notice'. Specifically, the user undertakes to use the contents, products/services in a diligent, correct and lawful manner, undertaking in all cases to:
- Not to use the contents and products/services for purposes contrary to the law, morality, good faith, good customs or public order.
- Not to reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the information contained on the website, unless prior authorisation has been granted by the owner of the rights.
- Not to use the contents or information to send advertising, communications for direct sales purposes or for any other commercial purpose, spam or unsolicited messages addressed to a number of people regardless of their purpose, and not to use, market or disclose in any way such information and products/services, unless there is prior authorisation from the owner of the rights.
Accessing, browsing and using the website does not require registration. However, in order to access the contracting of products/services, prior registration on the Website is required. To this end, the user will be responsible for providing truthful and lawful information and will use an identifier and password to verify their identity.
The password will be personal and non-transferable. It must be generated by the user following the rules of complexity established at all times by the Website. The password created by the user shall be valid for an unlimited period of time, although the user may change his/her password whenever he/she considers it appropriate, especially when he/she suspects or verifies that the confidentiality of the password has been reduced in any way.
Therefore, the user undertakes to make diligent use of his/her password, keeping it permanently secret, without disclosing it to third parties, not even to the Administrator of the Website. In this way, users become and are responsible for the custody and confidentiality of the identifiers/passwords they have chosen as users, and for the unlawful use of the Website by any illegitimate third party who uses for this purpose the password of said user which, due to improper custody or loss of the same, has been stolen.
In this case, the user must contact the contact details provided for any improper use of the identifiers/passwords, so that they can be cancelled. Until such events are notified, the owner and/or administrator shall be exempt from any liability that may arise from the improper use of the identifiers/passwords by unauthorised third parties.
By using the services, the user declares his/her conformity with these General Conditions, undertaking not to transmit, disseminate or make available to third parties through the services provided by the Website any kind of material that in any way contravenes current legislation.
Access, browsing and use of the Website is the responsibility of the user, who therefore undertakes to diligently and faithfully observe any additional instructions given by the owner and/or administrator of the Website.
5. INTELLECTUAL AND INDUSTRIAL PROPERTY
The owner of the website is the owner of the industrial and intellectual property exploitation rights of the website or has the corresponding authorisation for the intellectual, industrial and image property rights of the contents that appear on the website.
Under no circumstances shall it be understood that access and browsing by the user implies a waiver, transmission, licence or total or partial transfer of said rights by the owner. The user enjoys a strictly private right of use, exclusively for the purpose of enjoying the products/services in accordance with these Conditions.
Therefore, it is not permitted to remove, avoid or manipulate the copyright notice and any other data identifying the rights of the owners incorporated in the contents, as well as any technical protection device, or information and/or identification mechanisms found in the contents.
Likewise, it is forbidden to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or successive publications, upload files, send by mail, transmit, use or distribute in any way, in whole or in part, the contents included on the website for public or commercial purposes, without the written and signed authorisation of the owner of the corresponding rights.
References to names and commercial or registered trademarks, logos or other distinctive signs, whether owned by the owner and/or administrator or third party companies, imply a prohibition on their use without the due consent or that of their legitimate owners. In no way, unless expressly stated, does access to and/or use of the Website, its contents and/or products/services, confer on the user any rights over the trademarks, logos and/or distinctive signs included therein, which are protected by law.
All Intellectual and Industrial Property rights over the contents and/or products/services are reserved, and in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute in any way all or part of the contents and/or products/services included on the Website, for public or commercial purposes, without the written and signed authorisation of the owner of the corresponding rights.
6. COMMUNICATIONS

The User acknowledges that he/she assumes responsibility and shall hold harmless the owner and/or administrator for any communication that he/she provides personally or on his/her behalf, such responsibility reaching without restriction to the accuracy, legality, originality and ownership of the same.
7. USE OF COOKIES AND IP
The user accepts that the administrator uses cookies and IP tracking in order to collect data for statistical purposes only, such as: date of first visit, number of times visited, date of last visit, URL and domain from which it comes, browser used and screen resolution. However, the user may deactivate and/or delete these cookies by following the instructions of his/her Internet browser, and has the right to be informed of these options at any time.
8. LIABILITIES AND WARRANTIES
The owner and/or administrator of the website does not guarantee and is not responsible for:
- Continuity of web content.
- The absence of errors in such content, products and/or services.
- The absence of viruses and/or other harmful components on the website or on the server that provides it.
- The invulnerability of the Website and/or the impregnability of the security measures adopted therein.
- The lack of usefulness or performance of the contents, products and/or services of the Website.
- Damage or harm caused, to themselves or to a third party, by any person who infringes the conditions, rules and instructions set out on the Website or through the violation of the Website's security systems.
- The absence of viruses or other elements in the services provided by third parties through the website that may cause alterations in the user's computer systems, electronic documents and/or stored files.
However, the owner and/or administrator declares that it has adopted all necessary measures, within its possibilities and the state of technology, to guarantee the functioning of the website and to avoid the existence and transmission of viruses and other harmful components to users' computer systems.
Furthermore, it has no obligation to control and does not control the use that users make of the Website, its contents, products and/or services. In particular, it does not guarantee that users use the Website, the contents, services and/or products in accordance with this 'Legal Notice' and, where applicable, with the Specific Conditions that may be applicable.
In fact, it is exempt from any liability for damages of any kind that may be due to the use of the contents, products and/or services by users or that may be due to the lack of veracity, validity, completeness and/or authenticity of the information that users provide to other users and, in particular, although not exclusively, for damages of any kind that may be due to the impersonation of a third party by a user in any kind of communication made through the Web.
It may even withdraw or suspend at any time and without prior notice the provision of products/services to those users who do not comply with the provisions of this 'Legal Notice'.
For its part, if the user becomes aware of the existence of any content that is illicit, illegal, contrary to the law or that could involve an infringement of intellectual property rights and/or industrial property, it must be notified immediately through the contact details provided so that the appropriate measures can be taken.
Specifically, it does not guarantee the availability and continuity of the operation of the Website, and when reasonably possible, it will give prior warning of any interruptions in the operation of the Website.
It also disclaims any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of the Website, its content, products and/or services, and in particular, but not exclusively, to failures in access and its operability.
In the event of temporary interruption of the service attributable to a third party, fortuitous event or force majeure, it shall not be liable for any damages that such interruptions may cause directly or indirectly to users.

9. LINKS TO OTHER SITES
1. Links to other websites.
In the event that the user could find links to other web pages on the website, these would be managed and belong to third parties, and therefore the owner and/or administrator has no possibility of controlling the contents, services, products or information contained therein at the time of access by the user, and for this reason shall not be responsible for any aspect relating to the web page to which a link could be established.
In the event that users have actual knowledge of the unlawfulness of activities carried out through these third-party websites, they should immediately notify this through the contact details provided on the website so that the link to the website can be disabled.
The establishment of any type of link from the Website to another external website does not imply that there is any type of relationship, collaboration or dependence between the Website and the party responsible for the external website.
2. Links to the website on other websites.
If you would like to establish any kind of link on another, external, web page to the Website, you must do so in the following manner:

The reproduction of the Web, as part of its Web or on any of the pages of the Web is expressly prohibited.
- Any statement that you have authorised such a link is also prohibited, unless previously declared in writing by the owner and/or administrator.
- The use of the brand, denomination, trade name, commercial name, sign, logotype or any other type of identifying element of the website on other websites is prohibited, except with the written and signed authorisation of the owner and/or administrator.
- The owner and/or administrator does not authorise in any way the establishment of a link to the website from those web pages that contain materials, information or contents that are illicit, illegal, degrading, obscene and, in general, that contravene morality, public order or generally accepted social norms.
- The owner and/or administrator has neither the power nor the human and technical means to know, control or approve all the information, content, products or services provided by other websites that have established links to the Website. Therefore, it does not assume any type of responsibility for any aspect relating to the website that establishes such a link to the Website, specifically, and merely by way of example, for its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.
